What the IRS Doesn’t Tell You About Liens, Levies, and Garnishments

The IRS is the most powerful collection agency in the United States. They can take your wages, seize your bank accounts, and place liens on your property — all without going to court.

Here’s how it works:

Liens – A legal claim against your property to secure the payment of taxes.

Levies – Actual seizure of your property or funds.

Wage Garnishments – A portion of your paycheck is sent directly to the IRS.

What most people don’t know:
You have rights, and the IRS must follow certain procedures before taking action.

With proper representation, many collection actions can be paused while the case is reviewed. In some cases the IRS accepts less than the full amount through an Offer in Compromise, subject to strict eligibility rules.

FREQUENTLY ASKED QUESTIONS

The examples below are illustrative composites — not specific clients; details have been changed and combined, and results depend on your facts.

Q: Will I have to talk to the IRS myself?
A: No. Once you sign a Power of Attorney, I deal directly with the IRS for you. You won’t have to sit on hold, explain your situation to a stranger, or risk saying something that could hurt your case. My role is to be your voice, your shield, and your advocate.
Example (illustrative composite): a self-employed contractor in the Pacific Northwest had let IRS calls go unanswered for a month. Once Form 2848 was on file, the IRS directed its calls and letters to me and he did not have to take another call.

Q: Will I continue receiving letters from the IRS?
A: At first, you may still receive some automated letters that were already in the system before I took over your case. After that, all new correspondence comes to me. You’ll have the reassurance of knowing you don’t have to open or respond to anything without my review and guidance.
Example (illustrative composite): a retiree in the Midwest arrived with a year of unopened IRS mail. After the power of attorney was filed, new correspondence came to me first, and we read the old letters together, one at a time.

Q: Can the IRS levy all of my paycheck?
A: They can take a substantial portion — often leaving you with only enough for the most basic living expenses. In some cases, clients are left with less than $500 per paycheck. That’s why time is critical. With the right representation I move to have a garnishment released or reduced quickly; the IRS can act within days once a release is approved.
Example (illustrative composite): a warehouse supervisor in the Southeast had most of each paycheck going to a levy. Within the week the release was issued and a payment plan was in place. Timing depends on the IRS unit handling the case.

Q: How fast can you stop IRS collections?
A: It depends on the type of action. Wage garnishments and bank levies are often released within a few business days once the request and documentation are in; the key is catching it before the IRS processes the next scheduled collection. Every day matters.
Example (illustrative composite): a restaurant owner in the Mountain West called two days before a bank levy was to post. We assembled the hardship documentation overnight, and the levy was released before the funds left the account. It does not always resolve that quickly.

Q: Will the IRS just go away if I ignore them?
A: No — ignoring IRS notices is the fastest way to escalate your problem. Interest and penalties compound daily, and once the IRS begins enforcement, it’s much harder to reverse. The sooner you act, the more options we have.
Example (illustrative composite): a property manager in New England ignored notices for well over a year. By the time he called, a lien had been filed, an account levied and wages garnished. It resolved — over months, not weeks.

Q: Do I need to come to your office?
A: No. I work with clients in all 50 states entirely virtually. We use secure portals, email, and phone calls to handle everything — no travel, no time off work.
Example (illustrative composite): a hospital shift worker in the Upper Midwest could not travel for meetings. Her mid-five-figure balance was resolved entirely by portal, email and phone, without a missed shift.

Q: How do I know if I qualify for an Offer in Compromise?
A: The IRS reviews your income, expenses, assets, and ability to pay. If your financial situation shows you can’t realistically pay the full amount, you may qualify. I’ll analyze your numbers in detail before we apply so you don’t waste time or money on a hopeless submission.
Example (illustrative composite): a consultant in the Mid-Atlantic owed a low six-figure balance. After a detailed look at income, expenses and assets, an Offer in Compromise was accepted for a fraction of the balance. Most taxpayers do not qualify; the numbers decide.

Q: Can you remove IRS penalties?
A: Yes, in many cases. Through penalty abatement, I can request that the IRS remove certain penalties, especially if you have a valid reason like illness, job loss, or natural disaster. This can dramatically reduce what you owe.
Example (illustrative composite): a schoolteacher in the Southwest had missed two filing seasons while caring for a parent. A reasonable-cause request removed the failure-to-file penalties; the tax itself was still owed.

Q: Is it too late if the IRS has already taken money from my account?
A: Not necessarily. Even after a levy, I may be able to recover funds — especially if the IRS took them without proper notice or if you can demonstrate hardship. And there are steps we can take to reduce the chance of it happening again.
Example (illustrative composite): a contractor in the Great Plains lost a five-figure sum to a levy that posted after a notice went to an old address. Part of the funds were returned on a hardship showing and collection was paused while a plan was set up. Returns of levied funds are the exception, not the rule.

Q: I owe the IRS but can’t afford to pay right now. Can you still help?
A: Absolutely. In cases of financial hardship, I can negotiate “Currently Not Collectible” status, which stops collections entirely until your situation improves. This gives you breathing room without the fear of levies or garnishments.
Example (illustrative composite): a single parent in the Northwest, between jobs, owed a five-figure balance. Currently Not Collectible status was granted, and enforcement stopped until her income recovered. CNC is reviewed periodically and interest continues to accrue.
